Constitutional objections and remedies

Lesson 1

Identify the exact government action or legal provision, the affected person, the relevant right, the facts supporting an infringement and the remedy sought. Check Charter applicability, jurisdiction, standing, procedural rules and deadlines with qualified counsel. Do not convert a political disagreement into a constitutional conclusion without analysis.

Lesson 2

Study both the alleged infringement and the government’s possible justification under Charter section 1. Organize evidence about the objective, connection between measure and objective, less impairing alternatives and proportionality. Include contrary authority and inconvenient facts. Distinguish an argument, a lawyer’s opinion and a court’s finding.

Lesson 3

Charter section 24(1) permits applications to a court of competent jurisdiction for appropriate and just remedies. Constitution Act, 1982 section 52(1) addresses laws inconsistent with the Constitution. Available relief depends on the case and forum. A CDDA objection letter, petition or notice does not itself invalidate a law, cancel a ticket, impose liability or stop a response deadline; seek advice promptly about the required proceeding.

Lesson 4

Practice: prepare a constitutional issue memo with the challenged text, dated chronology, rights analysis, government’s strongest response, missing evidence and a request for legal review. Separately propose a democratic safeguard addressing the demonstrated failure: consultation, written reasons, independent review or a lawfully enacted public-veto process. Label the reform proposal as a proposal.
